  • Someone is already using a similar trademark, can I still register it?
It would not be recommended to file a similar trademark because your trademark could be rejected for creating confusion among consumers. However, if the other mark is being used for different types or products and/or services then it would be possible for you to get the trademark because it will not cause any confusion between the brands. For example, take the trademark "Dove". Dove (Beauty) and Dove chocolates can coexist because their products are different enough to prevent confusion among customers.
  • How much does it cost to get a trademark?
We have created a special cost-effective package for filing your trademark with us as a small business or start-up. Get in touch with us to get a fee quote.
  • What should I do if someone infringes my trademark rights?
If someone infringes your trademark rights, you can take legal action against them to stop them from using your mark and claim damages for any losses you have suffered. It is recommended to consult with an attorney for advice on how to proceed. Get in touch with us!
  • Why should I file a trademark application in Singapore?
Filing a trademark application in Singapore can help protect your brand and prevent others from using or registering a similar mark. It also gives you the exclusive right to use the mark in connection with your goods or services.
  • How do I know how many classes to register my trademark in?
You should protect your trademark for the products and services you offer and include your expansion plans in the next 5 years. For example, if you have a clothing business, that you currently retail online. You would file a trademark under the classes that protect all the products you are selling online. You also think that in 5 years your clothing brand may expand to include bags and accessories. These items are in different classes. When you put it all together, your clothing brand retailing online would likely need to be protected in 4 classes.
  • What information do I need to provide in my trademark application?
You will need to provide the details of the mark you want to register, such as the name, logo, or image. You will also need to specify the goods or services you want to use the mark for and provide us with information about yourself or your business.
  • What happens after my trademark is registered?
Once your trademark is registered, you will receive a certificate of registration from IPOS. This gives you the exclusive right to use the mark in connection with your goods or services in Singapore for a period of 10 years, with the option to renew.
  • What is the registration stage?
This is where we receive and forward the certificate of registration to you. It is the last stage in the Trademark application process.
  • What is the filing stage?
This is the first stage in the trademark application process. This is where we file your application with the IP office, and we have all the filing particulars in hand, including your classes with your list of goods and services.
  • What is the publication stage?
This is the third stage in the trademark application process. This is where we report that your application has passed the examination stage and has been published in the Journal for any third party who might wish to oppose your application.
  • What is the examination stage?
This is the second stage in the trademark application process. After your application is filed, it will take four to six months for your application to be assigned to an examiner who will review the application to ensure that it complies with the rules and regulations, including whether it is registrable as a trademark and whether any other party has filed a similar earlier mark that would block your application. The fees here depend on whether the IP office raises any objections against your application and cannot be estimated yet.
  • Can I seek help from you if I receive an office action?
Yes, you can! Our trademark attorney can provide advice on how to respond to the issues raised and help you navigate the process.
  • How long do I have to respond to an office action?
You typically have two months to respond to an office action, although this can vary depending on the complexity of the issues raised.
  • What is an office action?
An office action is a communication from the Intellectual Property Office of Singapore (IPOS) that identifies issues or objections with your trademark application. This could be due to conflicts with existing marks or insufficient information provided in your application.
  • What if I disagree with the issues raised in the office action?
If you disagree with the issues raised in the office action, you can submit arguments or evidence to support your position. However, it is important to note that IPOS has the final say on whether to accept or reject your trademark application. Get in touch with us.
  • How long does it take to resolve an office action?
The time it takes to resolve an office action can vary depending on the complexity of the issues raised and how responsive you are. In some cases, it may take several months to resolve an office action.
  • What should I do if I receive an office action?
If you receive an office action, it is important to carefully review the issues or objections raised by IPOS and respond promptly with a suitable response. This may involve providing additional information or making amendments to your application. We offer special packages for overcoming official refusals from IPOS. Get in touch with us.
  • What happens if I don't respond to an office action?
If you don't respond to an office action within the given timeframe, your trademark application may be deemed abandoned and you may lose the opportunity to register your mark.
